When you enroll in the Blitz - Play Games SMS Program, you give your consent to ESPORT NEWCO SAS (”We”, “Us”, “Our”), its affiliates and its service providers to use an automatic telephone dialing system to deliver text messages to the mobile number to which you have directed ESPORT NEWCO SAS to transmit these text messages.

By opting-in to our SMS program, you agree to receive promotional messages and updates regarding our applications. These messages may include information about new games, promotions, bonuses, and account updates.

You acknowledge that carriers are not liable for delayed or undelivered messages.

You acknowledge this consent is not a condition of purchase or service.

2. MESSAGE FREQUENCY

You will receive a maximum of 10 messages per four weeks. However, the actual frequency may vary depending on the availability of new games, promotions, or other important updates.

3. INSTRUCTIONS

THIS AGREEMENT IS SUBJECT TO BINDING ARBITRATION AND THE WAIVER OF CLASS ACTION RIGHTS DETAILED IN OUR TERMS AND CONDITIONS.

By opting-in to our SMS program, ****you acknowledge and agree that:

• You are responsible for any message and data charges that may be incurred. We are not responsible for any fees charged by your mobile carrier;
• We will not be liable for any unauthorized access or interception of text communications with us;
• Text communications are not secure or encrypted and third parties can sometimes intercept messages or disguise messages as though they were sent by us. You agree that you will not text Us or Our affiliates any confidential or sensitive information;
• We will not be liable for any delays or failures in your receipt of any SMS messages as delivery can be unpredictable based on transmission from your network operator and processing by your mobile device. SMS message services are provided on an AS IS, AS AVAILABLE basis.

6. MMS

We may send MMS (Multimedia Messaging Service) messages, such as, but not limited to .jpgs, .png, .jpeg, .bmp, .txt, .doc, .docx, Liberty Mutual employee vCards, etc. If your device does not support such files, it is your responsibility to request the file be sent through different means (e.g. e-mail or mail).

7. PHONE NUMBER CHANGE

You agree that you will promptly notify Us if your mobile phone number changes.
